Der Bundesrat will den Hanfkonsum legalisieren. Die Landesregierung liess allerdings offen, ob auch der Anbau, Handel
und Verkauf von Cannabis entkriminalisiert werden sollen. Im Detail muss jetzt das Bundesamt für Gesundheit die Vorlage ausarbeiten. Frühestens im Februar 2001 wird in den eidgenössischen Räten über die Hanffrage debattiert. Ergreifen Rechtsparteien nicht das Referendum, dürfte die Abstimmung bereits 2002 stattfinden - gleichzeitig mit der Abstimmung über die Revision des Betäubungsmittelgesetzes, das auch die Heroinabgabe gesetzlich verankern will.

konkret:
-vorbereitung zum konsum und der konsum selbst sind straffrei.
-besitz(wohl auch anbau) für eigenbedarf straffrei
-anbau, herstellung und handel sind im grunde weiterhin straffbar, unterliegen aber dem oppurtonitätsprinzip. dies heisst, der handel etc wird nur in fällen verfolgt, wenn zb an unter 18jährige verkauft wurde oder eine gesundheitsgefährdung(???) besteht.(in holland besteht auch dieses modell, mit dem unterschied, dass auch der konsum darunterfällt)
-verkauf an nichtschweizer bleibt verboten!
-der konsum harter drogen unterlieget ebenfalls dem opp.prinzip

das ganze muss jetzt erst mal noch durch die mühlen der politik. wobei dort siehts ja recht gut aus.
bleibt nur zu hoffen, dass die svp keine volksinitiative lanciert, obschon es den prozess wohl nur verzögern würde.

The new draft law was introduced by the Swiss government in Bern today (Mar 9, 2001). Use, possession and cultivation of cannabis for personal use by adults will no longer be punished.

Sale and commercial cultivation of drug cannabis will handled in a similar
manner to Dutch coffee shops, i.e. they will remain technically illegal but
no action will be taken provided certain conditions are met. The main
objective there is to prevent exports of Swiss cannabis to less tolerant
neighbour countries such as Germany and France.

As an interesting coincidence, the Swiss law was introduced on the 7th
anniversary of a ruling by the highest court in next-door Germany that had
declared prosecution for possession small quantities of cannabis
incompatible with the German constitution. The Swiss reforms are sure to
increase the pressure on the German, Austrian and French governments to
also decriminalise cannabis.

SWISS CLEAR THE WAY FOR CANNABIS LEGALISATION

BERNE, March 9 (Reuters) - The Swiss government on Friday endorsed a draft law that would legalise the consumption of marijuana and hashish and allow a limited number of "dope shops."

The bill submitted to parliament seeks to bring Swiss law into line with the reality that one in four people aged 15-24 regularly gets high in the Alpine state, according to a poll commissioned last month by the Swiss government.

"Decriminalising the consumption of cannabis and the acts leading up to this takes account of social reality and unburdens police and the courts," the government said in a statement.

The cabinet agreed in principle in October to legalise dope smoking. It has now recommended that police be allowed to turn a blind eye to people growing and trading small amounts of soft drugs, arguing that this will make it easier to differentiate between small and large-scale production and export of drugs.

"A certain number of shops could be tolerated as well as the growing of hemp and the production of cannabis products, to the extent that conditions laid down by government decree are fulfilled," it said.

The cabinet also proposed a flexible approach to prosecuting use of other illegal drugs while still adhering to international treaties to fight drug abuse.

Swiss voters in 1998 rejected a proposal to legalise all drug consumption, possibly because Switzerland already has one of the most liberal approaches in Europe to treating heroin addicts -- providing free drugs and needles to junkies who do not respond to other forms of addiction therapy.

Switzerland once had the dubious honour of hosting Europe's largest open heroin scene in Zurich's "needle park," but city officials drove it underground in the mid-990s after the park became a mecca for Europe's drug addicts.
